§ 1 Glossary

  1. "SELLER" or "SELLER" - "Feelgood Spółka Z Ograniczoną Odpowiedzialnością", with NIP number: 9452179077, REGON number: 123104804 address for delivery: Feelgood, ul. TURYSTYCZNA 2, 31-213 Kraków
  2. "USER"- using the Online Store: (I) a natural person with full legal capacity; (II) a natural person who is at least 13 years old and has limited legal capacity, where the contract to be concluded is a contract commonly concluded for minor everyday matters, or where such a person has obtained the legally effective consent of a legal representative to conclude the contract; (III) a legal person; and (IV) an organizational unit without legal personality which is granted legal capacity by law-all designated Users acting as Entrepreneurs.
  3. "CONSUMER"- a natural person who would make a legal transaction with the Seller that is not directly related to his economic or professional activity.
  4. "ENTERPRISE"- a natural person, a legal person or a defective legal person, conducting a business or professional activity on its own behalf.
  5. "ONLINE STORE" - Internet service available at www.feelgood.pl owned and operated by the Seller, through which the User may purchase Goods from the Seller.
  6. "GOOD"- movable goods, presented in the Online Store, which can be the subject of a sales contract.
  7. "REGULATIONS"- this document.
  8. "OWN PRODUCT" - movable goods (primarily clothing, advertising gadgets) owned by the User, which the User delivers to the Seller for printing or decoration according to the User's order.
  9. "SELLER'S PRODUCT" - movable goods (primarily clothing, advertising gadgets) owned by the Seller, which the Seller will sell to the User after applying prints or decorations according to the User's order.

§ 2 General Provisions.

  1. The Internet store is run "Feelgood Spółka Z Ograniczoną Odpowiedzialnością", address: Feelgood, Kryspinów 380, 32-060 Liszki, e-mail address: kontakt@feelgood.pl, NIP number: 9452179077, REGON number: 123104804.
  2. These Regulations set forth the rules for the use of the online store located at: [link to the German and English versions of the Regulations, respectively], the performance of services provided electronically to the User (facilitating the conclusion of contracts for the sale of Goods between the Seller and the User), and the exercise of the User's rights under applicable law.
  3. The technical condition required to use the Online Store is that the User or registrant has access to:
    1. A computer or other multimedia device with Internet access,
    2. email,
    3. Internet browser: Mozilla Firefox version 11.0 and above or Internet Explorer version 7.0 and above, Opera version 7.0 and above, Google Chrome version 12.0.0 and above or Safarin version 17 and above,
    4. The ability to enable cookies and Javascript technology in your web browser,
    5. Adequate screen resolution of the device referred to under the letter of this paragraph (the recommended screen resolution by the Seller is 1024x768).

§ 3 Services provided electronically.

  1. Registration in the Online Store, holding an assigned account in the Online Store, and placing orders and concluding a sales agreement with the Seller may be performed only by Users who have the status of entrepreneurs within the meaning of Article 4(1) et seq. of the Act of March 6, 2018- Entrepreneurs' Law. Provision of services by electronic means by the Seller is excluded for persons and entities other than entrepreneurs, in particular to the extent that these persons and entities would act in relation with the Seller as consumers within the meaning of Article 221 of the Act- Civil Code.
  2. Services provided electronically to the User (free of charge) by the Seller are the following: registration in the Online Store, maintaining an account in the
    Online Store, access to the inventory of Goods and the order basket, enabling the conclusion of the relevant sales contract.
  3. With regard to services provided electronically, these Regulations constitute the rules and regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of electronic services. The Regulations are addressed to all users of the Online Store, as well as registrants, subject to paragraph 1. of this section. Persons referred to in the preceding sentence are obliged to comply with all provisions of the Regulations.
  4. Registration of an account by the User in the Online Store is possible only after reading the Terms of Use and accepting its conditions. The registrant confirms the fulfillment of the above conditions by selecting the appropriate option in the registration form.
  5. The Account service is provided for an indefinite period of time. The User has the option, at any time and without giving any reason, to delete the Account by sending the appropriate request to the Seller via e-mail to the following e-mail address: kontakt@feelgood.pl.
  6. Other services listed in this paragraph are provided on a one-time basis and are terminated upon completion of the ordering or registration process.
  7. At any time the User has the right to file a complaint regarding the provision of the services indicated in this paragraph. The User may submit a complaint via e-mail to: complaint@feelgood.pl

§ 4 Rights and obligations of the User

  1. In particular, the user is obliged to:
    1. use the services offered by the Seller in a manner that does not cause interference with the functioning of the Online Store, in particular through the use of specific software or devices,
    2. not to take action to come into possession of classified information in the possession of the Vendor,
    3. provide complete and factually correct data (the User is responsible for providing personal data that does not belong to him or is false),
    4. keep your login and password to your account on the Online Store confidential,
    5. use of the services offered by the Seller in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the customs accepted in a given field,
    6. use the services offered by the Seller in a manner that is not onerous for other Users and the Seller, with respect for their personal rights (including the right to privacy) and other rights to which they are entitled,
    7. use of any content posted within the Online Store only for your own personal use (in particular, it is forbidden to copy it or share it with third parties and entities).
  2. The Seller may deprive the User of the right to use the Online Store
    in case of:
    1. providing false data during registration or when placing an order,
    2. finding of violation of the obligations referred to in this paragraph,
    3. loss of entrepreneurial status.
  3. Recording and securing the content of the concluded agreement and making it available to the User is carried out by:
  4. making the Terms and Conditions available on the website of the Online Store,
  5. sending the User a confirmation of the order to the e-mail address from which the order was placed, together with a copy of the Terms and Conditions,
  6. Attach to the shipped Goods the proof of purchase,
  7. Fixing the content of the order in the Seller's computer system.
  8. The Seller shall take all possible technical and organizational measures to prevent acquisition and modification by unauthorized persons of the data provided during registration and when placing orders

§ 5 Prices and fees payable for delivery of ordered Goods

  1. The user can place an order to purchase from the Seller:
  • Goods that are in the standard offer (without their personalization)
  • Personalized goods (prints/decorations according to individual needs of the User, which the User himself provides to the Seller using the product wizard available in the panel of each product).
  1. All prices of Goods posted on the website of the Online Store:
    • are given in EUR or in another currency, clearly indicated on the website of the Online Store
    • do not include VAT, which, if the User indicates in the international tax number field an active tax number in the VIES system, the Sale is settled under the European VAT reverse charge procedure, in the absence of indication of the User's active tax number in the VIES system, the Seller retains the right to charge VAT at its Polish rate of 23%.
    • do not include information on delivery costs.
  2. The prices of the Goods (standard, without personalization) offered in the Online Store are valid until a new price list is approved, in accordance with the Seller's pricing policy. The Seller reserves the right to change the prices of the Goods on offer, to introduce new Goods to the offer of the Online Store and to remove unavailable Goods, to carry out and cancel promotional actions and sales or to introduce changes in them. The above right shall not affect the prices of the Goods in orders placed before the effective date of the price change, terms of promotional actions or sales.
  3. Promotions in the Online Store are not combinable, unless the terms and conditions of the promotion state otherwise.
  4. The price binding for both parties is the price given in the order summary before the User presses the "Order with obligation to pay" button.
  5. The cost of delivery and collection of the Goods shall be borne by the User.
  6. To the value of the ordered Goods will be added the cost of their delivery / shipping. Thus, the final cost of the order consists of the total value of the ordered Goods and their shipping cost. Information about the shipping cost appears when the User selects the delivery method and form of payment.
  7. The Seller reserves the right to make changes in the prices of shipments. This does not apply to shipments of Goods already ordered and in progress.
  8. The price of Personalized Goods is determined individually, depending on the number of products, delivery date and other requirements of the User.

§ 6 Placing and accepting orders

  1. The subject of orders on the Online Store website are:
  2. Standard goods (without personalization) available in the offer located at www.feelgood.pl at the time of ordering (order mode described in this paragraph in paragraphs 2-5),
  3. Personalized goods (order mode described in this paragraph in paragraphs 5- 13).
  4. The User places an order for Goods using the "Order Cart".
  5. By clicking on the "Add to cart" icon, the User accepts the selected Goods according to their description and price and expresses his/her will to purchase them in accordance with the Regulations.
  6. When the User presses the "order and pay" button, a sales contract is concluded. The User undertakes to pay the indicated price (and, moreover, to accept the provisions of the Regulations), and the Seller undertakes to deliver the Goods to the address indicated in the order.
  7. After placing an order, the User will receive a message to the indicated e-mail address containing a confirmation of the order placed.
  8. The user places an order for Personalized Goods using the "Personalized Order Basket".
  9. In the "personalized order basket", the user selects the option "Own Product" or "Seller's Product", respectively.
  10. The User is obliged to send (in JPG, PNG, PDF format) visualizations of prints or decorations to be applied by the Seller to the User's own Product or the Seller's Product. The Seller shall, within 5 working days, confirm acceptance of the visualization or make acceptance of the order conditional on the User or the Seller making changes. The User must make changes or accept the introduction of changes by the Seller within a maximum period of 5 days from the date of receipt of the Seller's position. If the deadline is not met, the order is considered not confirmed. If the Seller discovers that the visualizations of the prints or ornaments, which are the subject of the order, are inconsistent with the description of the order (in particular, by using more colors or in the case of inconsistencies in the choice of colors), he may refuse to carry out the order or request a change in the order setting an appropriate deadline for this purpose.
  11. Submission of visualizations by the User is equivalent to submitting the following statement: "I declare that I am entitled to all rights, in particular, copyright and related rights, to the submitted visualizations that constitute a work within the meaning of the Law on Copyright and Related Rights - to the extent of ordering the Seller to make prints and decorations. I authorize the Seller to use these works for the purpose of performance of the concluded agreement (performance of overprints / decorations). I undertake that in the event that any claims are made by a third party against the Seller for infringement of intellectual property rights as to the submitted visuals (works), I will cover all legitimate claims of the applicant, in particular remuneration, damages, costs of court proceedings and pre-litigation and enforcement actions, as well as cover the costs incurred by the Seller related thereto (litigation costs, costs of pre-litigation actions .I will also join the process on the side of the Seller as an intervening party."
  12. In the case of own Products, the User is obliged to deliver the own Product at his own expense and risk to the Seller (by courier or registered mail) to the address to be indicated (in the form of an e-mail) by the Seller (on the territory of Poland) within a maximum of 5 days from the date of acceptance of the order by the Seller. The risk of damage or loss of Own Products shall pass to the Seller at the time of their receipt. Failure or delay in delivery of Proprietary Products shall result, at the Seller's option, in the Seller's right to withdraw from the contract in whole or in part, or to postpone the date of execution of the order by the length of the period of delay in delivery.
  13. The time of conclusion of the agreement is the confirmation of the order by the Buyer by clicking the button on the homepage when ordering "order with obligation to pay" or when the buyer confirms the seller's offer in text form (e-mail, chatbox) and the seller accepts the order.
  14. The delivery date of the order will be specified in the confirmation of order acceptance. For standard Goods order, the shipping date is 14 working days from the date of order acceptance. The approximate lead time for the order of Personalized Goods is: for Own Products- 14 days from the date of delivery of Own Products to the Seller; for Seller's Products- 14 days from the date of acceptance of the order.
  15. The seller is entitled to refuse to process an order if it has knowledge that the submitted visualization violates the intellectual property rights of third parties, contains content or images that violate the law, praising the use of violence, inciting racial, ethnic, religious hatred or otherwise praising discrimination on any grounds, as well as obscene.

§ 7 Order processing procedure, contractual right of withdrawal with waiver

  1. Successful completion of the order is possible only if the Goods (standard) selected by the User are available in the Seller's warehouse. Information about availability can be found on the website. If it turns out that the Seller has inconsistencies between the information provided on the website of the Online Store and the actual stock, the User is informed of this fact and has the opportunity to change the order in whole or in part (without incurring any costs).
  2. In the event that the order cannot be fulfilled, due to the lack of availability of the selected Goods, the Seller has the right to withdraw from part of the contract (only to the extent of the unavailable Goods), and the order will be cancelled in whole or in part, of which the User will be informed electronically, to the e-mail address provided by the User. The payment made by the User for the ordered Goods, which cannot be delivered, will be refunded by the Seller within 7 working days from the date of effectively informing the User about the impossibility of fulfilling the order.
  3. In the case of sales of Promotional Goods or those on sale, the
    quantity of which is limited, orders will be processed on a first-come, first-served basis until stocks are exhausted.
  4. The Seller stipulates, and the User accepts, that the order completion date may be changed (extended) in a situation of force majeure, as well as failure of the Seller's electronic systems, failure of printing, printing and similar equipment and machinery, problems with supply of goods (in particular, lack or delay of supplies to the Seller for reasons beyond the Seller's control) or problems with access to the Internet or electricity. The extension of the order lead time will last as long as the events described in the preceding sentence, which are the prerequisites for the change of the deadline, lasted. The maximum order processing time is 30 working days.
  5. In the case of ordering prints/decorations on Seller's own Products or Seller's Products, you acknowledge and agree that:
  6. Prints/decorations made on the basis of visualizations sent by the User may differ slightly in terms of color from the visualization, which is due to the display parameters of electronic devices, the characteristics of the Seller's own Products/Products and the printing/decoration methods used - and the User will not make any claims on this account;
  7. Any Goods constituting clothing or textiles (including standard Goods) are subject - in terms of size - to a tolerance of +- 10% from the declared size (width, length, depth - all together and each separately), and in terms of shrinkage and grammage - to a tolerance of +- 5% - and the User will not make any claims on this account;
  8. in the case of prints/decorations on the User's own Products, up to 2% of the quantity of entrusted own Products may be damaged or destroyed in the course of production operations, and the User will not make any claims on this account (both in terms of repairing the damage as to the loss of the item in question, as well as failure to perform the contract as to the item so lost);
  9. The Seller is entitled, for production reasons, to execute the order with a quantitative tolerance of +-5% of the Goods, with the proviso that in the event of an increase in the quantity of the Goods within these limits, the User shall pay a relative surcharge, and in the event of a decrease in the quantity of the Goods within these limits, the User shall pay for the quantity actually executed (delivered); a quantitative change of +-5% shall not entitle the User to refuse to accept the Goods, and the order in question shall be considered duly executed by the Seller.
  10. Modification of a placed order requires - for its validity - separate arrangements between the Seller and the User, made at least in documentary form.
  11. Orders for prints/decorations on Seller's own Products/Products are not cancelable. The right to return the ordered goods in such cases is excluded. These cases are regulated in Article 38 of the Law on Consumer Rights. The aforementioned law regulates the process of returns, defining that the right of return does not apply to items that are not prefabricated, manufactured to the consumer's specifications or that serve to meet the consumer's individualized needs.
  12. In the case of an order for standard Goods, the User has a contractual right to withdraw from the contract in whole or in part - which, in order to be valid, requires payment of a deviation in the amount of 25% of the net value of the entire order. The Seller shall be entitled to deduct the withdrawal from the already paid remuneration. The right of withdrawal is exercised within 7 days from the date of the order.

§ 8 Forms of payment

  1. The user has the right to choose the following payment methods for the ordered Goods:
    1. "prepayment in PLN" to the Seller's account given during the ordering procedure,
    2. "prepayment in PLN" via ApplePay/PayU/PayPal system before delivery.
  2. Delivery costs are indicated each time during the ordering process and may vary depending on the delivery method selected by the User and the weight of the Goods ordered. The User is always informed about the cost of delivery in the automatically generated order summary available to him/her before the final declaration of the contract.
  3. For some Goods (due to their size and/or weight), the User will not have a choice of all the payment methods indicated in paragraph 1 of this section.

§ 9 Rules of order delivery

  1. The Seller shall deliver the ordered Goods in the manner indicated by the User from among the following (the User shall make a choice when placing an order):
    1. by courier service - via DPD courier company
    2. by large-volume courier service (so-called pallet service - the Goods are delivered on a pallet) - via DPD courier company
  2. All Goods offered in the Online Store are brand new and have been legally introduced into the Polish market, unless the description of the Goods placed in the Online Store indicates otherwise.
  3. The user acknowledges and fully accepts that large-volume courier shipments (i.e., weighing more than 31.5 kg) are delivered in the so-called "to the first door" system. This means that the courier does not deliver the shipment
    to the apartment or business premises, but leaves it at the front door/gate, etc.
  4. Delivery is possible only on the territory of the Republic of Poland and the European Union

§ 10 Correspondence

  1. In order to facilitate and improve the procedure of making purchases in the Online Store, the User agrees to conduct e-mail correspondence. As part of it, the User will receive, at the e-mail address provided when logging in:
  2. messages regarding the Goods ordered by him and the current status of the order. The content of e-mails includes information about the order: number, status, list of ordered Goods with prices, amount to be paid, form of payment, method of delivery, address details, etc.
  3. Confirmation of registration - after registration in the Online Store, the registrant receives confirmation of registration, along with a request for authorization.
  4. order confirmation - when the User approves the order, including the list of ordered Goods, prices, form of payment and method of delivery, the User receives information confirming the receipt of the order. It includes the order number, a listing of the ordered Goods with prices, information on the form of payment and method of delivery, as well as the shipping destination address.
  5. information about payment by electronic transfer - if the User has chosen such a payment option, he or she receives the relevant information. In the event of problems, the e-mail contains a request to retry the payment.
  6. information about shipment of the order - once the ordered items are fully completed and shipped, the User receives a message confirming this fact, along with information about the address to which the shipment was sent.

§ 11 Place and manner of filing complaints (warranty, guarantee).

  1. The Seller may provide a warranty for the Goods, or the Goods may be covered by warranty protection provided by the manufacturer. Each time, all warranty rights (as well as the procedure for their implementation) are described in the warranty statement.
  2. The user can make a claim under the following rules:
    • A complaint notification may be sent to the Seller
      via e-mail to adres: complaint@feelgood.pl,
    • The User for the most efficient complaint process
      in the complaint application to indicate: Goods that are subject to the complaint (by indicating the name of the Goods or the order number), the reason for the complaint (e.g. by indicating the defect of the Goods or their non-compliance
      with the contract), the date of occurrence of the defect/non-compliance of the Goods
      with the contract, the content of the request (the User should indicate, moreover, whether he/she is pursuing his/her claims under the warranty or liability under the warranty), the preferred method of obtaining a response to the complaint, and his/her contact information.
    • The seller will respond to the complaint within 30 days of receipt.

§ 12 Final provisions. Out-of-court ways of dealing with complaints and claims. Recycling.

  1. In matters not regulated by these Terms and Conditions, only the provisions of Polish law shall apply, in particular the provisions of the Civil Code, excluding the conflict of laws rules, rules of private international law, including the provisions of the United Nations Convention on Contracts for the International Sale of Goods of 11.04.1980, as amended (CISG). Polish law shall also be applicable to the consideration of disputes arising against the background of the validity or performance of sales contracts concluded by the User with the Seller.
  2. The competent court for disputes arising from the contract of sale concluded by the User with the Seller is the court having jurisdiction over the registered office of the Seller.
  3. The Regulations are available electronically on the website of the Online Store.
  4. The Seller reserves the right to change the Terms and Conditions at any time, and any changes will be effective from the date of notification to the User. Orders placed before the date of introduction of the changes are executed on the basis of the provisions in force on the date of placing the order.
  5. Photos of products on the pages of the Online Store are for illustrative purposes only, the ordered Goods may slightly differ from those presented in the photo, especially in terms of color.
  6. The Seller points out that parts of the Goods (containing electrical
    and electronic components
    ) must not be disposed of together with other household waste. A user intending to dispose of such Goods is obliged to give them to a collection point for used electrical and electronic equipment. For this purpose, contact the Seller. In addition, the Seller informs that in each municipality there is a free collection point for used equipment. Information about such points can be found on the website or the bulletin board of the Municipality. By taking care to dispose of the Goods in an appropriate manner, you can prevent potential negative consequences for the environment and human health.
  7. These Regulations are effective as of 22.02.2024
